If you file and get your refund before the 12-month grace period is over (which is August), then yes, the will not take it. But don’t make the finacnial mistake of NOT applying for Fresh Start. You can fix your financial situation right now.

First, you should do Fresh Start to get out of this situation with your loans. Second, offsets should not impact taxes if you file by April – the on-ramp period is 12 months.
